These Terms & Conditions of Use and the policies and documents incorporated herein (collectively, the “Terms”) govern your use of FrigidaireOutdoorLiving.com and any associated sites, services, applications, platforms, and product registration forms (collectively, the “Site”). The Site is provided by Turpone Product Licensing Inc. (referred to as the “Company”, “us”, “we”, or “our” as the context may require).

The Company is an authorized licensee of the Frigidaire brand and independently administers product registration and related customer support services for Frigidaire branded BBQ grills. The Company is not Electrolux Consumer Products, Inc. or Electrolux Canada Corp.

THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY.

BY USING THIS SITE OR SUBMITTING A PRODUCT REGISTRATION, YOU ACCEPT AND ARE BOUND BY THESE TERMS.

YOU MAY NOT USE THIS SITE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (i) AT LEAST 18 YEARS OF AGE OR (ii) LEGAL AGE TO FORM A BINDING CONTRACT IN YOUR JURISDICTION, OR (C) ARE PROHIBITED FROM ACCESSING OR USING THIS SITE OR ANY OF THIS SITE’S CONTENTS OR SERVICES BY APPLICABLE LAW.

ARBITRATION AND WAIVER OF JURY TRIAL. WHERE PERMITTED BY APPLICABLE LAW, AND EXCLUDING INDIVIDUAL RESIDENTS OF QUEBEC, THESE TERMS CONTAIN PROVISIONS FOR BINDING ARBITRATION AND A CLASS ACTION WAIVER. WHEN ARBITRATION IS INVOKED FOR CLAIMS SUBJECT TO ARBITRATION, YOU AND THE COMPANY WILL NOT HAVE THE RIGHT TO PURSUE THAT CLAIM IN COURT OR HAVE A JURY DECIDE THE CLAIM, AND YOU WILL NOT HAVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION OR SIMILAR PROCEEDING.

 

1. Modifications and Termination

 

These Terms are subject to change by the Company without prior written notice at any time, in our sole discretion. The latest version of these Terms will be posted on this Site, and you should review these Terms periodically. Your continued use of this Site after a posted change constitutes your acceptance of the updated Terms. If you do not agree to any changes, you may stop using the Site at any time.

2. Your Account

 

You may be required to create an account and specify a username and password in order to use certain services or content on the Site, including product registration features. To create an account, you must be at least 18 years old and provide truthful and accurate information. It is your responsibility to keep your account information confidential and up to date.

You agree that you are responsible for all activities that occur under or related to your account. We reserve the right to terminate or suspend your account for any reason, to the extent permitted by law.

The Site may provide the opportunity to post text, photographs, videos, reviews, ratings, comments, communications, or other content (collectively, “Content”). You may only post Content if it is not confidential and you own all rights to it, or you have permission from the rights holder.

You do not transfer ownership of your Content by posting it. However, by posting Content (excluding your personal information), you grant the Company, its agents, licensees, and assigns a non-exclusive, worldwide, transferable, royalty free, perpetual right to reproduce, encode, store, copy, transmit, publish, post, display, adapt, modify, create derivative works of, and otherwise use your Content in connection with operating the Site and Services. This license continues even if you stop using the Site.

You agree not to post Content that is unlawful, false or misleading, harassing, abusive, defamatory, obscene, infringing, or that violates privacy or publicity rights, or that is otherwise objectionable. We reserve the right, but do not have the obligation, to remove Content at our discretion, as permitted by law.

You agree to indemnify the Company against liability, claims, actions, losses, damages, injuries, costs, or expenses arising out of Content you post or your use of the Site, to the extent permitted by law.

4. Content Posted by Others

 

We are not responsible for, and do not endorse, Content posted by any other user. You agree that we will not be liable for any loss or damage caused in connection with Content posted by another person.

5. Third Party Content and Services

 

The Site may link to or integrate with third-party websites, applications, products, or services (“Third Party Services”). Such links are provided for convenience and do not represent endorsement. Your use of Third Party Services may be subject to third-party terms and privacy policies. We are not responsible for Third Party Services.

Except for personal information governed by our Privacy Policy, any material, information, or idea you transmit or post to the Site may be treated as non-confidential and non-proprietary and may be used by the Company for purposes related to operating the Site and Services.

7. Your Use of the Site

 

You may not use the Site in a way that violates any laws, infringes rights, is offensive, or interferes with the Site or any features of the Site (including any measures we employ to enforce these Terms). If we determine you have acted inappropriately, we may remove Content, terminate accounts, restrict access, and take appropriate legal actions, as permitted by law.

Using the Site does not give you ownership of any intellectual property rights to the content you access. You may not use content from the Site unless you obtain permission or are otherwise permitted by law.

8. Product Registration and Connected Features

 

Product registration is intended to facilitate warranty administration, customer service, and product safety communications. Registration does not replace the requirement to retain proof of purchase for warranty claims. Warranty coverage, if applicable, remains subject to the written warranty terms provided with the product or otherwise made available to you.

If the Site includes features related to connected products or digital services, you acknowledge that such features may require a working internet connection and compatible equipment. You are responsible for any charges from your internet service provider or mobile carrier.

To the maximum extent permitted by applicable law, the Company makes no warranty that any connected features or digital services will be uninterrupted, timely, secure, error free, or fully compatible with all devices or networks.

9. Trademarks, Copyrights and Other Intellectual Property

 

The Company and, as applicable, its licensors or third parties are and will remain the owners of the intellectual property rights in and to the Site and its contents, including copyrights, trademarks, and other proprietary rights.

Frigidaire is a registered trademark used under license. All other trademarks are the property of their respective owners.

You agree not to infringe upon these rights. We grant you a limited, personal, non-commercial right to use the Site for its intended purposes.

10. Copyright Protection

 

If you believe any content on the Site infringes your copyright, you may request removal by contacting us and providing:

Identification of the copyrighted work
Identification of the allegedly infringing material and its location
Your name, address, telephone number, and email address
A statement of good faith belief
A statement that the information is accurate and you are authorized to act
A signature or electronic equivalent

27. Governing Law and Jurisdiction

 

For users not resident in Quebec, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules, and the courts located in Toronto, Ontario have jurisdiction.

For individuals resident in Quebec, these Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, and the courts located in Montréal, Quebec have jurisdiction.
